Short Term Rental Agreement & HOA Rules
This Short-Term Rental Agreement (hereinafter: the “Agreement”) is entered into and made effective as of the signing date by and between the Property Owner/Operator (“LESSOR or AGENT”) and the GUEST (together – the “Parties”). Terms not specified in this Agreement shall be in accordance with the House rules, HOA Rules, or the Reservation policies which are provided separately by the Owner. The parties agree as follows:
1. This rental agreement and waiver of liability is binding on both the Owner and/or its Agents, and the GUEST, and spells out the legal rights and obligations of both parties. The GUEST is the person renting the property under this written rental agreement, from the owner (or owner’s agent), who is the LESSOR.
2. This document affects your legal rights. You need to read it carefully. In consideration of paying the rent, GUEST is allowed to participate, rent and use the property and its menities, on the dates confirmed by the rental confirmation.
3. Damage Deposit is held to secure the faithful performance of this agreement and obligations relating to the rent, repairs and professional cleaning services for any damage or excessive cleaning caused during occupation of the premises. Damage deposit will be used to cover additional charges made, services hired, or that are not covered by the Guesty Accident Insurance policy. The damage deposit is cashed and held until the inspection of home is completed, by owner’s agent, after departure. The lessee shall report any breakage, damage, or malfunction incurred during stay. FOR ANY HOUSE ISSUES, CALL JEFF OR JANET FIRST! We give you the phone numbers of our local team for emergencies. We can solve most house-related issues and will hire them if needed. Do not call this staff without calling us first! You are calling them is your hiring them at your expense (unless urgent or we are not available)
4. *Accidental Damages to Rental Property. Accidental damage protection is required and included for any damages or accidents, subject to exclusions and limitations that occur to the premises during your rental period, of up to $5000 ($89). Any damage or accident that is not covered under the policy will be the responsibility of the GUEST.
5. Any suit for damages to the property, more than both the damage deposit and property rental damage insurance, if any, will be subject to the laws of the State of Utah.
6. CHECK-IN / CHECK-OUT: Check-in is 4:00 PM. Entry information will be provided after all fees and contracts are in place. Early arrival is ONLY available if arrangements have been made in advance. Check-out is 11:00 AM. Prompt check-out is required to allow enough time to prepare the house for the next guest. Late check-out is ONLY available if arrangements have been made in advance.
7. DEFAULT OF PAYMENT OR FAILURE TO VACATE: In the performance or compliance with any term, condition, or regulation hereof the LESSOR, at its option, shall terminate the occupancy of the tenant and may enter the premises, take possession and recover damages, including costs and attorney’s fees.
8. NO SMOKING! We have a strict non-smoking policy.
9. NO FIREWORKS OR FIREARMS of any kind are allowed. This is a strict policy and will result in immediate action and expulsion from the property, with no refund. If Lessee intends on legal hunting during their stay, please inform the agent prior to occupancy.
10. HOUSE APPLIANCES: Every effort is made to ensure the proper working condition of all equipment in the house. In the event of a malfunction, please inform us immediately. We will take quick action to correct to the best of our ability. Weekend, Holiday or Evening technician visits is not guaranteed. Also, continuation of appliances is not guaranteed and will not be considered breach of contract. Early communication is key in getting repairs started as soon as possible.
11. QUIET ENJOYMENT: The Guest shall behave in a respectful manner and shall be good neighbors respecting the rights of the surrounding property owners. Creating a disturbance of the above nature shall be grounds for immediate termination of this agreement. Occupancy and use of these premises shall not disturb or offend neighbors or residents. The Agent has the prerogative to send staff to correct behavior and charge for this hiring or to terminate this agreement, and to ask disruptive guests to vacate the premises without a refund.
12. HOUSEKEEPING: There is no daily housekeeping service. Lines and bath towels are included in the unit. Linens are to remain at the house. Mid-stay cleaning can be arranged at guest equest and expense.
13. GARBAGE: Easy instructions. Headache if not followed! There are two large trash bins. All garbage needs to be put into white or black plastic bags and tied off.
On Sunday night (BASIN 02 is Tuesday night), please roll the bins and any excess boxes or bags (be mindful of what animals may want and seal accordingly) to the curb. Pick- up is super early on Monday morning (BASIIN 02 is Wednesday morning). $50 will be charged if trash is not taken out, as our staff must remove. $75 if they must go to the dump in Ogden. Please break down all boxes.
14. HOUSES WITH HOT TUBS ARE SUBJECT TO THE FOLLOWING:
· NO TODDLERS ARE ALLOWED THAT ARE NOT POTTY TRAINED
· NO SITTING OR PLAYING ON THE COVER
· NO RUNNING IN AND OUT AND INTRODUCING EXCESS DIRT
· NO GLASS CONTAINERS
· ADULT SUPERVISION IS REQUIRED
· RELAX AND ENJOY THE HOT TUB, BUT PLEASE HELP KEEP IT CLEAN!
· PLEASE DO NOT CHANGE PROGRAM SETTINGS.
15. The hot tub is serviced weekly. Please help us to keep it clean and sanitary.
16. Drain and fill are $200. Guests will be expected to pay for this if the tub is dirty or smells of urine.
17. The Guest agrees to abide by all rules and regulations set forth by local laws.
18. The Guest commits not to use the property for any illegal or commercial purpose, including but not limited to sub-lease the property or otherwise allowing anyone or more people to stay above the maximum permitted or if not previously agreed with the Owner.
19. The Guest is responsible for any breakage or damage costs (or related costs) in or to the property – along with any extra costs that may result – which are caused by the Guest or any members of the Guest’s party.
20. The Owner can refuse to allow the Guest into the property or ask the Guest to leave if they reasonably believe the Guest or any member of the Guest’s party (or any other person invited by the Guest to the property) are behaving illegally or that any damage is likely to be caused, has been caused or is being caused as a result of the Guest behavior or any members the Guest has invited to the property and without providing a refund of any payment the Guest has paid for the booking and the Owner will not be legally responsible to find any alternative
accommodation.
21. Parking is limited to designated parking areas only. No street parking is allowed in the Trapper’s Ridge HOA Neighborhood.
22. The Guest must not hold events (such as parties, celebrations, or meetings) at the property without the advance written consent of the Owner. Any of these cases will allow the Owner to terminate the Agreement without providing a refund of any payment the Guest has paid for the booking and the Owner will not be legally responsible to find any alternative accommodation.
23. The Guest must allow the Owner or their representative (including workmen), with reasonable notice, access to the property at any reasonable time during your stay (except in an emergency or if a problem needs sorting out quickly and you cannot be contacted in time. In these situations, the owner can enter the property at any time without giving you prior notice).
24. The Guest is obliged not to make any changes in the rented property without prior receipt of agreement from the Owner in writing.
25. I (we) hereby voluntarily accept all risk of personal injury, death, illness, and property damage (including personal property) to myself (ourselves), our family or anyone on the premises with our permission, which injury or damage results from our use of the premises. Furthermore, I (we) agree thatI (we) will not make a claim against or bring suit: Snowbasin Vacation Rentals, LLC, or its agents, Optima Maid Services, or its agents, homeowner, or its agents, family, related entities (Released Parties), or Trapper’s Ridge Home Owners Association for any bodily injury, death, illness or property damage. I (we) understand that this is a release of Homeowner and agents from all liability with respect to any claims brought by guests or invitees for any damage, illness, or injury. All of the units are privately owned; Snowbasin Vacation Rentals, Optima Maid Services and homeowners are not responsible for the
loss of personal belongings or valuables of the guest. In booking this rental property, Lessee freely assume all risks, both known and unknown.
26. Any suit for damages to the property, more than both the damage deposit and property rental damage insurance, if any, will be subject to the laws of the State of Utah.
27. Additional Policies such as Rates and Fees, Cancellations, Minimum Stay, Smoking, Pets, Maximum Guests allowed, Children and age, Security Deposit etc. will be according to the House rules or the Reservation policies which are provided separately by the Owner.
28. ACCEPTED AND AGREED BY LESSEE(S) AS EVIDENCED BY THE UNDERSIGNED SIGNATURE: For Guests of any Trapper’s Ridge Homes, including TR50, TR54, TR63, TR122 & TR123, the following
HOA Rules will apply as well. TRAPPERS RIDGE HOMEOWNERS’ ASSOCIATION SUMMARY OF RULES AND REGULATIONS FOR GUESTS AND RENTERS All renters and guests are subject to the Trappers Ridge Homeowners Association Community Rules, and Clubhouse/Swimming Pool/Hot Tub/Fitness Center/ Tennis and Basketball Courts Rules which are prominently posted in your rental unit as well as at the Trappers Ridge Clubhouse. The rules below are a compilation of the rules listed above and are provided as a courtesy to our short-term guests. PARKING
• All vehicles should be parked in an enclosed garage. Motor vehicles exceeding garage capacity must be parked in driveways or designated overflow parking areas only. Overnight parking of any vehicle on public or private streets is prohibited. Vehicles of any type are prohibited from parking on lawns.
• No boats, trailers, campers, motor homes, recreational vehicles, large trucks, or commercial vehicles belonging to renters, owners, or other residents of the development shall be parked in driveways, on lawns, or on the street. Temporary parking in overflow spaces may not exceed 72 hours in any seven-day period. Overflow parking is limited. Overflow parking will not accommodate vehicles more than twenty-five feet in length. The clubhouse parking lot is not an overflow parking area.
• Motor homes and campers may not be used as accommodation (living, sleeping, or cooking).
• Motorized vehicles are not permitted on walking trails.
COMMUNITY RULES
• Quiet hours are from 10:00 PM to 8:00 AM, but residents have a right to Quiet Enjoyment regardless of thetime of day. The use of portable outside speakers is prohibited. Please be considerate of your neighbors when enjoying your patios or hot tubs.
• The speed limit inside the community is 25 mph and 10 mph at the traffic circle (roundabout). Please obey the speed limits and exercise caution on curves and hills. Please obey the one-way signs at the traffic circle. Yield
• Trash cans should be moved to the curb on Sunday evening and returned to the garage by Monday night. rash cans must not be visible from the street from Tuesday through Sunday. To maintain the neat appearance of ourcommunity, trash cans should not be stored on driveways and front porches.
• Dogs must always be on leashes or under owner control. Pets should not be allowed to bark excessively or create a nuisance for other members of the community. Please clean up after your pet. Do not deposit dog waste in the clubhouse trash cans. 2/3 TRHOA Rules Summary for Renters and Guests CLUBHOUSE, SWIMMING POOL, HOT TUB, FITNESS CENTER, AND TENNIS AND BASKETBALL COURTS
• The clubhouse, swimming pool, hot tub, fitness center, tennis and basketball courts are for the exclusive use of the Association’s members, their invited guests, and renters.
• The clubhouse facility is under 24-hour electronic surveillance.
• Pool attendants and members have the full authority of the Homeowners Association to enforce these rules and policies.
• Clubhouse and pool hours are from 8:00 am to 9:00 pm seven days a week (weather permitting). From 8:00 am to 11:00 am daily, the pool and hot tub are reserved for lap swimming only and quiet use of the pool and hot tub is mandatory.
• Guests and renters who use the pool facilities acknowledge the inherent risk of swimming and swimming at their own risk. There are no lifeguards on duty. The basic rules of safety, as posted, must always be observed.
• Please respect the rights of others when using the clubhouse amenities.
• Guests and Renters may bring no more than eight members of their party to the pool, spa, or clubhouse at one time.
• Each home has eight wristbands assigned to it. These wristbands must be worn when guests/renters are in the pool and hot tub areas as well as in the clubhouse. If you do not have a fob and wristband, you will be asked to leave.
• Replacement wristbands are available from the HOA for $10 each.
• To gain access to the clubhouse facilities, use the fork provided by the owner of your rental unit. If you do not have the fob in your possession, you will be asked to retrieve it before you are granted entry. DO NOT prop the clubhouse doors or fence gate open for any reason.
• Please observe posted pool and hot tub capacity limits.
• In accordance with Utah Admin. Code 392-302-31: All children under the age of fourteen must be accompanied and supervised by a parent or responsible adult (18 or older) when using the pool or hot tub.
o Children under f`ive (5) are not permitted in the hot tub at any time.
o Pregnant women and those with heart conditions should consult their physicians before using the hot tub.
o Do not spend more than 15 minutes in the hot tub.
• The hot tub is intended to be used by adults and older children for quiet relaxation. It is not a kiddie pool. For the health and safety of all users, no jumping into the hot tub, no horseplay in or around the hot tub, or swimming/ducking underwater is permitted.
• Babies must wear swim diapers and plastic pants in the swimming pool. DO NOT LEAVE SOILED DIAPERS in the clubhouse trash.
• No food or drink is allowed in the pool or hot tub. Glass containers are not allowed anywhere in the hot tub or pool area. Portable grills are not permitted in the pool area. Pets are not allowed in the clubhouse, hot tub, or pool area.
• Access to the restrooms from the fenced pool area is through the door nearest the gate. A job is required. To protect our clubhouse furniture, no damp or wet swimwear or clothing is to be worn inside the clubhouse except for the use of the restrooms. 3/3 TRHOA Rules Summary for Renters and Guests
• The sliding door between the clubhouse and patio is permanently locked. Do not attempt to open it.
• Tents and shade canopies are not permitted inside the fenced pool area. They may be erected on the grassy area to the west of the pool.
• Running, diving, and horseplay are NOT permitted in the pool and hot tub areas.
• Water toys and music must not be a nuisance to other swimmers and guests. Music and sound devices should be used with earbuds or headphones. Portable speakers are not permitted in the common area.
• Bicycles and skateboards may not be ridden inside the fenced-in pool area.
• Please replace the hot tub cover and outdoor furniture before leaving. Do not move indoor furniture.
• Guests and renters who use the fitness equipment acknowledge the inherent dangers of its usage and work out at their own risk.
• The basic rules of safety must always be observed.
• For the safety of everyone using the fitness center, users should be experienced in using all equipment safely and appropriately.
• The fitness center is NOT a play area. Horseplay is not allowed.
• The fitness center is under 24-hour electronic surveillance. If equipment is damaged because of intentional misuse or willful misconduct by guests or renters, owners will be billed for the damaged equipment (repair or replacement).
• The tennis court is for tennis and pickleball only. No bikes, skateboards, inline skates, or dogs are allowed inside the fence.
• The basketball court may be used by guests and renters during daylight hours only. Thank you for your cooperation!
